Itse Sagay had to say about it.<br /> <br /> <br /> Constitutional lawyer, Prof. Itse Sagay, has warned that the acquisition of seven warships purportedly by ex-Niger Delta militant, Government Ekpemupolo also known as Tompolo, poses a threat to the nation’s security.<br /> <br /> Sagay, who condemned the purported acquisition in a statement on Tuesday, said the Nigerian constitution does not approve of any individual carrying out security duties on Nigerian waters except the country’s armed forces.<br /> We had earlier reported that Tompolo had denied the reports that he bought the decommissioned Norwegian warships and upgraded them with new weaponry, saying it was part of attempts to tarnish his image as well as force him to withdraw his support for President Goodluck Jonathan ahead of the 2015 elections.<br /> <br /> However, in his statement yesterday, Sagay said “The news of the recent acquisition by Tompolo’s Company, Global West Vessel Service of seven war vessels, is extremely disturbing and destabilising.  Given the volatile nature of Warri/Benin Rivers Area, and the over bearing violence of the Ijaw against the Itsekiri in particular, this is a sinister and dangerous development.<br /> <br /> “There is no provision in Nigerian Law that permits the engagement of private persons and outfits to carry arms and engage in security operations in Nigerian waters.  This duty is the exclusive responsibility of the Nigerian Navy.  Section 3 of the Armed Forces Act, Cap. A 20 of the 2004 Laws of Nigeria provides as follows:<br /> <br /> “(3)The Armed Forces shall be charged with the defence of the Federal Republic of Nigeria by land, sea and air and such other duties as the National Assembly may, from time to time, prescribe or direct by an Act”. (4) Notwithstanding the generality of the provisions of subsection (3) of this section –<br /> (a)The Navy shall, in particular, be further charged with – (i) enforcing and assisting in co-ordinating the enforcement of all customs, laws, including anti-bunkering, fishery and immigration laws of Nigeria at sea (ii) enforcing and assisting in co-coordinating the enforcement of national and international maritime laws ascribed or acceded to by Nigeria”.<br /> <br /> The constitutional lawyer, therefore, urged the Federal Government and security agencies not to treat the matter with kid gloves, describing the development as a blatant illegality.<br /> “Therefore the present situation in which Mr. Government Ekpemupolo has been allowed to bring in a naval fleet into the Western Delta area of Nigeria constitutes not only a  threat to peace in that area, but also a blatant illegality”, he said.<br /> <br /> Culled from www.informationng.com

Chapter II, section II, paragraph 1 of the bill opens with the intent to completely annihilate any attempt of public demonstration.</span></div> <div style="background-color: white; border: 0px; color: #030000; font-family: georgia; font-size: 12px; line-height: 19px; margin-bottom: 15px; padding: 0px; vertical-align: baseline;"> <span style="border: 0px; font-family: inherit; font-size: 12pt; font-style: inherit; font-weight: inherit; margin: 0px; padding: 0px; vertical-align: baseline;">It states; “Whoever, acting alone as an accomplice or an accessory, commits or threatens to commit an act likely to cause death, endanger physical integrity, cause bodily injury or material damage, destroy natural resources, the environment or cultural heritage with intent to: a) </span><span style="border: 0px; font-family: inherit; font-size: 12pt; font-style: inherit; font-weight: inherit; margin: 0px; padding: 0px; vertical-align: baseline;">intimidate the public, provoke a situation of terror or force the victim, the government and/or a national or international organization to carry out or refrain from carrying out an act, adopt or renounce a particular position; b) disrupt the normal functioning of public services, the delivery of essential services to the public or create a crisis situation among the public; c) create widespread insurrection in the country; d) shall be punished with the death penalty.”</span></div> <div style="background-color: white; border: 0px; color: #030000; font-family: georgia; font-size: 12px; line-height: 19px; margin-bottom: 15px; padding: 0px; vertical-align: baseline;"> <span style="border: 0px; font-family: inherit; font-size: 12pt; font-style: inherit; font-weight: inherit; margin: 0px; padding: 0px; vertical-align: baseline;">The wording of the bill makes it difficult to draw a line between terrorism and public demonstration. Chapter II, section 4 of the bill harps on what it refers to as ‘laundering of terrorism. “Whoever: a) procures, receives, keeps converts, transfers dissimulates or disguises goods that are proceeds or acts of terrorism; b) partakes in the use or sharing, even occasionally, of proceeds of acts of terrorism; shall be punished with the death penalty.”</span></div> <div style="background-color: white; border: 0px; color: #030000; font-family: georgia; font-size: 12px; line-height: 19px; margin-bottom: 15px; padding: 0px; vertical-align: baseline;"> <span style="border: 0px; font-family: inherit; font-size: 12pt; font-style: inherit; font-weight: inherit; margin: 0px; padding: 0px; vertical-align: baseline;">Under this clause, journalists could be very vulnerable, especially when section 8 of the law prescribes severe sanctions on individuals who disseminate publicly, the activities of ‘terrorists.’</span><br /><span style="border: 0px; font-family: inherit; font-size: 12pt; font-style: inherit; font-weight: inherit; margin: 0px; padding: 0px; vertical-align: baseline;">“Whoever publicly acclaims acts of terrorism shall be punished with imprisonment of from fifteen (15) to twenty (20) years or a fine of from Twenty-five million FCFA (25.000.000) to fifty million (50.000.000) or both such imprisonment and fine.”</span></div> <div style="background-color: white; border: 0px; color: #030000; font-family: georgia; font-size: 12px; line-height: 19px; margin-bottom: 15px; padding: 0px; vertical-align: baseline;"> <span style="border: 0px; font-family: inherit; font-size: 12pt; font-style: inherit; font-weight: inherit; margin: 0px; padding: 0px; vertical-align: baseline;">Owing to the peculiarity of the said offences, the bill places offenders exclusively under the jurisdiction of military tribunals, while the provisions of the penal code, the criminal procedure code and the military justice code that are not repugnant to the law shall, going by the bill remain applicable.</span></div> <div style="background-color: white; border: 0px; color: #030000; font-family: georgia; font-size: 12px; line-height: 19px; margin-bottom: 15px; padding: 0px; vertical-align: baseline;"> <span style="border: 0px; font-family: inherit; font-size: 12pt; font-style: inherit; font-weight: inherit; margin: 0px; padding: 0px; vertical-align: baseline;">Meanwhile, the SDF parliamentary group issued a memo signed by the group leader, Joseph Banadzem condemning the immensity of the bill and distancing themselves from it. The average life expectancy there is only 47. His chances would be even be slimmer now, as Ebola ravages the nation. Smith has lived in the United States for 25 years and came as an immigrant sponsored by his sister. <br /> <br /> To give back, three years ago he began a small volunteer organisation, Hope for Lives in Sierra Leone, to help the disadvantaged in his homeland. When the Ebola epidemic began this year, Smith got donations of medical supplies, such hospital gowns, masks and gloves, to send to the country’s main hospital in the capital, Freetown, to protect health workers there. He’s also been sending rolling beds and wheelchairs since the facility doesn’t have any. <br /> <br /> His mission has become personal since two of his relatives in Sierra Leone have died from Ebola. “My people are dying,” he said. “I’m just trying to help as much as I can.”<br /> <br /> Unused, usable supplies<br /> <br /> Smith knows what it’s like to save lives, since he works on the surgical team in the trauma unit at Suburban Hospital in Bethesda, Maryland. Much of what he ships back home are surplus items donated by hospitals, which Smith says can be put to good use in a country sorely lacking medical supplies. <br /> <br /> Pointing to partial rolls of medical tape, he explained, “[The hospitals] don’t want to reuse it, so they’re just going to dump it.”<br /> <br /> Along with other volunteers, Smith packs the materials at a warehouse in Fairfax, Virginia, belonging to the Brother’s Brother Foundation, a U.S. charity that provides medical supplies to needy countries. Luke Hingson, president of the group, calls Smith inspirational. “He sees a problem and works to bring the best out of other people to solve the problem.”<br /> <br /> A Maryland chapter of the international service organisation Rotary Club has donated $5000 to Hope for Lives in Sierra Leone. Barbara Ott, head of the group, says Smith stands out in the work he does for others, “by giving his heart and soul and personal resources.”<br /> <br /> More than medicine<br /> <br /> During the past three years, Smith has also jump-started other projects.<br /> <br /> Some fishermen in Sierra Leone didn’t have boats, so using his own money, plus donations, he bought three boats for them to share. <br /> <br /> His former primary school didn’t have a library, so he helped build one and filled it with books. <br /> <br /> And when Smith sent over four thousand pairs of donated shoes, he saw the eyes of schoolchildren light up. “It’s like Christmas for them,” he said.<br /> <br /> He also has handed out meals for homeless amputees, living together in camps, who lost their limbs during Sierra Leone’s brutal 11-year-long civil war that ended in 2002. The Nigerian, <span style="color: #3d85c6;">Kelvin Ogodogu</span>, was arrested on Saturday, November 15 through the help of some of his neighbours in Kosoa in the Central region for trying to defraud a US-based <span style="color: #3d85c6;">Ghanaian lady</span>. The Nigerian, posing as Majid Michel on Facebook, solicited funds from unsuspecting persons, including the US-based Ghanaian lady, Ikay, to bury his mum. Kelvin Ogodogu was arraigned before the La Dadekotopon Municipal Assembly (LaDMA) Magistrates’ Court in La on Thursday, November 20 where he pleaded not guilty to the charges of impersonation and attempted fraud. During the second hearing on Tuesday, November 25, presided over by Judge Charles Yaw Boateng, State Prosecutor, Chief Inspector Ophelia Denteh led the award winning actor to give his evidence. Majid Michel gave an account of how he met Ikay and how the lady informed him about the imposter on Facebook. His 45 minute narration also included an account of how he set up a surveillance system to help apprehend Kelvin. Kelvin asked Majid what he discussed with Ikay when they met in the US which the actor answered. The accused also quizzed the actor when Ikay realized that she was dealing with an ‘imposter’ on Facebook. Majid responded that it was a day after the event that the lady realized. The court after taking Majid’s account then adjourned the case to Thursday, November 27. Yet he echoed Brown's parents in calling for any protests to be peaceful, saying that their wishes should be honoured as they grieve their son.<br /> <br /> At the same time, Obama sought to dispel the notion that race relations have deteriorated, the protests in Ferguson notwithstanding. He called for Americans to turn their attention to ways to bring police and their communities closer together.<br /> <br /> "That won't be done by throwing bottles. That won't be done by smashing car windows. That won't be done by using this as an excuse to vandalise property," Obama said. "It certainly won't be done by hurting anybody."<br /> <br /> Yet the scene playing out in suburban Missouri, just minutes after the grand jury's announcement, stood in stark contrast to Obama's calls for calm. As Obama spoke live from the White House briefing room, television networks showed Obama on one side of the screen, and violent demonstrations in Ferguson on the other.<br /> <br /> Police said protesters smashed windows, vandalised police cars and threw rocks at authorities as anger erupted after the announcement Monday night that Wilson, a white officer, wouldn't be indicted for shooting Brown.
